PETITION TO ESTABLISH PATERNITY, DETERMINE CUSTODY AND TIME SHARING, AND AWARD CHILD SUPPORT
COMES NOW, DAVID LOPEZ, the Petitioner, represented by and through his attorney, Gary Lakin, and alleges:
1. The Petitioner is a resident of Bernalillo County.
2. CANDICE DELGARITO is the mother of the minor child.
3. DAVID LOPEZ is the father of the minor child,
4. The name, date of birth and age (13) of the minor child is AMYA GAYLENE CAYADITTO born 07-13-2008.
5. That the Petitioner has not had visits with the minor child since 2016.
6. Petitioner admits paternity.
7. The father and mother of the child were never married.
8. That a Parenting Plan should be established providing for Joint Legal Custody with Primary Physical Custody with Mother and specific times of visitation with the Petitioner.
9. That child support shall be calculated in accordance with NM Child Support Guidelines.
WHEREFORE, Petitioner prays for the Court to establish paternity of the minor child, order Child Support according to the New Mexico Child Support Guidelines, establish custody and visitation and grant such other further relief as the Court deems just and equitable.
