NOTICE OF PENDENCY OF SUIT
THE STATE OF NEW MEXICO TO: MICHAEL K. LYLE; and any and all unknown persons who may claim any lien, interest or title adverse to Plaintiff
I, David Borunda, Court Administrator of the Third Judicial District Court in the County of Dona Ana, State of New Mexico, do hereby cause to be issued this Notice of Pendency of Suit, for the purpose of service of process on MICHAEL K. LYLE; and any and all unknown persons who may claim any lien, interest or title adverse to Plaintiff by publication.
The names of the Plaintiff, Defendants, and the Court in which said cause is pending and the civil cause number are set out hereinabove.
The Defendants against whom service by publication is sought to be obtained are MICHAEL K. LYLE; and any and all unknown persons who claim any lien, interest or title adverse to Plaintiff.
The general object of this action is to quiet and to set at rest the title of Plaintiff in and to the lands described herein against any adverse claims of the Defendants and that the Defendants be barred and estopped from having or claiming any lien upon, any right or title to the estate of Plaintiff in and to said lands, or any portion thereof, adverse to the Plaintiff.
The property which is affected and concerned by this pending action is located in Dona Ana County, New Mexico, and more particularly described as follows, to wit:
Lot 32, of COUNTRY CLUB MANOR, located in the City of Las Cruces, County of Dona Ana, State of New Mexico as shown on Plat thereof recorded on March 11, 1957 in Plat Book 1, at Page(s) as Plat No. 458, records of Dona Ana.
SAVING AND EXCEPTING THEREFROM a 2,130.24 square foot tract of land conveyed to the City of Las Cruces on November 3, 2006 in Book 761 at Pages 166-169, records of Dona Ana County, and being more particularly described as follows:
A tract of land located within the corporate limits of the City of Las Cruces, Dona Ana County, New Mexico in Section 31, T.22 South, R.2 East, N.M.P.M. also part of that property filed December 15, 1989 in Deed Book 337, Page 54, in the records of Dona Ana County, and being more particularly described as follows, to wit:
BEGINNING at a ½” found iron rod being the northwest corner of the tract herein described, identical to the northwest corner of Lot 32, County Club Manor No. 1 Subdivision, as filed March 11, 1957 in plat record 1, page 32, Dona Ana County WHENCE a ½” iron rod found to be the northeast corner of Lot 32 of said subdivision, bears N 65°09’54”E, a distance of 199.56 feet;
THENCE N 65°09’54”E, a distance of 21.35 feet to the northeast corner of the tract herein described, marked by a set ½” iron rod with cap stamped NMPS 5949;
THENCE S 24°59’05”E, a distance 2.16 feet to an angle point of the tract herein described, marked by a set ½” iron rod with cap stamped NMPS 5949;
THENCE N 64°58’04”E, a distance 2.00 feet to an angle point of the tract herein described, marked by a set ½” iron rod with cap stamped NMPS 5949;
THENCE S 24°59’05”E, a distance 2.00 feet to an angle point of the tract herein described, marked by a set ½” iron rod with cap stamped NMPS 5949;
THENCE S 64°58’04”W, a distance 2.00 feet to an angle point of the tract herein described, marked by a set ½” iron rod with cap stamped NMPS 5949;
THENCE S 24°59’05”E, a distance 96.45 feet to the southeast corner of the tract herein described, marked by a set ½” iron rod with cap stamped NMPS 5949;
THENCE S 64°52’57”W, a distance of 20.90 feet to the southwest corner of the tract herein described, marked by a found ½” iron rod with cap stamped NMPS 9761;
THENCE N 25°14’36”W, a distance 100.71 feet to the place and point of beginning, containing 2130.24 square feet of land more or less.

Subd: COUNTRY CLUB MANOR 458 Lot: 32 S: 31 T: 22S R: 2E
Commonly known as 4004 Elks Drive, Las Cruces, New Mexico.
