NOTICE OF PENDENCY OF SUIT
THE STATE OF NEW MEXICO TO: THE UNKNOWN HEIRS AND DEVISEES OF ESIQUIO AND CELEDONIA BUSTAMANTE, deceased; and any and all unknown persons who may claim any lien, interest or title adverse to Plaintiffs.
I, Nicole Vasquez, Court Administrator of the Third Judicial District Court in the County of Dona Ana, State of New Mexico, do hereby cause to be issued this Notice of Pendency of Suit, for the purpose of service of process on any and all unknown persons who may claim any lien, interest or title adverse to Plaintiff.
The names of the Plaintiff, Defendants, and the Court in which said cause is pending and the civil cause number are set out hereinabove.
The Defendants against whom service by publication is sought to be obtained are: THE UNKNOWN HEIRS AND DEVISEES OF ESIQUIO AND CELEDONIA BUSTAMANTE, deceased; and any and all unknown persons who may claim any lien, interest or title adverse to Plaintiff.
The general object of this action is to quiet and to set at rest the title of Plaintiff in and to the lands described herein against any adverse claims of the Defendants and that the Defendants be barred and estopped from having or claiming any lien upon, any right or title to the estate of Plaintiffs in and to said lands, or any portion thereof, adverse to the Plaintiff.
The property which is affected and concerned by this pending action is located in Dona Ana County, New Mexico, and more particularly described as follows, to wit:
DESCRIPTION OF A 0.580 ACRE TRACT (TRACT A)
A tract of land being part of Block 8 of the Stafford Plat of the La Mesa Townsite as filed February 19, 1892 in the Doña Ana County Clerk’s Office Records, in La Mesa, Doña Ana County, New Mexico and being more particularly described as follows:
BEGINNING at a 1/2” iron rod found with cap (DONOHUE 8172) along the easterly Right-of-Way line of San Jose Road (an existing 40’ R/W) for the southwest corner of this tract, WHENCE a 1/2” iron rod found for the northwest corner of said Block 8, bears the following two courses and distances;
N32°48’28”W, a distance of 115.52 feet; THENCE N32°47’07”W, a distance of 242.85 feet;
THENCE from the point of beginning, N32°48’28”W, 65.28 feet to the northwest corner of this tract;
THENCE leaving San Jose Road, N62°45’46”E, 147.68 feet to a corner of this tract;
THENCE N32°47’37”W, 50.24 feet to a corner of this tract;
THENCE N62°45’46”E, 13.07 feet to a 1/2” iron rod found with cap (DONOHUE 8172) for corner of this tract;
THENCE N32°48’28”W”, 71.61 feet to a 1/2” iron rod found with cap (DONOHUE 8172) for a corner of this tract;
THENCE S57°11’32”W, 12.93 feet to a 1/2” iron rod found for a corner of this tract;
THENCE N32°48’28”W, 8.48 feet to a 1/2” iron rod found for a corner of this tract;
THENCE N57°11’32”E, 138.52 feet to a 1/2” iron rod set with cap (NMPS 23880) along the west line of the La Mesa Drain (EBID) for the northeast corner of this tract;
THENCE along the west line of the La Mesa Drain, S00°45’51”W, 50.87 feet to a 1/2” iron rod set with cap (NMPS 23880) for a corner of this tract;
THENCE continuing along the La Mesa Drain, S16°03’50”E, 143.71 feet to a 1/2” iron rod set with cap (NMPS 23880) for the southeast corner of this tract;
THENCE leaving the La Mesa Drain, S57°11’32”W, 216.06 feet to the point of beginning, containing 0.580 acres of land, more or less.
AND
DESCRIPTION OF A 0.259 ACRE TRACT (TRACT B)
A tract of land being part of Block 8 of the Stafford Plat of the La Mesa Townsite as filed February 19, 1892 in the Doña Ana County Clerk’s Office Records, in La Mesa, Doña Ana County, New Mexico and being more particularly described as follows:
BEGINNING at a 1/2” iron rod found for the northwest corner of this tract, WHENCE a 1/2” iron rod found for the northwest corner of said Block 8, bears the following two courses and distances; N32°48’28”W, a distance of 101.00 feet; THENCE S56°44’31”W, distance of 152.94 feet;
THENCE from the point of beginning, N57°11’51”E, 155.00 feet to a 1/2” iron rod found on the westerly line of the La Mesa Drain (EBID), for the northeast corner of this tract;
THENCE along the La Mesa Drain, S16°51’19”E, 81.69 feet to the southeast corner of this tract;
THENCE leaving the La Mesa Drain, S57°11’32”W, 132.56 feet to the southwest corner of this tract;
THENCE N32°48’28”W, 78.56 feet to the point of beginning, containing 0.259 acres of land, more or less.
